My problem doesn't happen very often either, but it's not just thinking it's closed. The symptoms point to it having essentially "frozen" in sleep mode. Closing the lid and re-opening doesn't fix it. I then will have to hold down the power button and turn off the system. They also offer some promotional content through the Nintendo Zone app.&amp;#160; StreetPass only requires proximity to another 3DS; it doesn't require an Internet connection to be configured nor does it require you to be in a Nintendo Zone.&amp;#160; Tip: I'm fairly sure that using the wireless functionality of your 3DS for Internet access will inhibit your ability to obtain a StreetPass at the same time.
